A Landmark Achievement in the Mediation Process
Among the many long-standing disputes lingering in the courts, a notable success was achieved in the resolution of a civil suit between two close relatives. This case, titled Title Suit No. 16 of 2010, originated from Civil Suit No. 37 of 1981, and involved the matter of Jeetendra Ram Prasad vs. Samundri Devi.
The dispute had been pending in various courts for at least 31 years, but was finally settled through mediation at the Mediation Centre, East at Gangtok, on 24th May, 2012 — bringing much-needed relief to the litigating parties and the Referral Court.
ACTION TAKEN DURING COVID-19 PANDEMIC
Due to COVID-19 pandemic and upsurge in the number of positive COVID-19 cases in the State, the Advocate Mediators were reluctant to conduct the cases physically. Therefore, an online training on “How to conduct Mediations through Online/Virtual Mode” was organized for the Advocate Mediators by Sikkim SLSA under the aegis of MCPC, New Delhi on 7th August, 2021 virtually wherein 33 Advocate Mediators (Gangtok: 21, Mangan: 01, Namchi: 10 & Gyalshing: 01) were trained by Ms. Pusshp Gupta, Trainer MCPC, Supreme Court of India, New Delhi.
PUBLICITY DRIVE
- Since the introduction of Mediation as an ADR mechanism in the State, awareness programmes have been conducted regularly in different parts of the State by the SLSA, DLSAs and TLSCs along with Panel Lawyers and PLVs
- Mediation is one of the major components in the Micro-Legal awareness programmes conducted by the District Legal Services Authorities and Taluk Legal Services Committees at the District and Taluk Levels
- Sikkim SLSA as part of an awareness drive broadcasts the message on Mediation and its benefits as an ADR mechanism through local F.M. Radio, All India Radio. Occasionally, awareness messages are also telecast in the local cable T.V. network
- A film on Mediation in Nepali with subtitles in English has been produced by SLSA which is displayed during Awareness Programmes
- Pamphlets on Mediation as prepared by the Mediation and Conciliation Project Committee, Supreme Court of India have been translated and printed from English to the three local languages of the State (Bhutia, Nepali and Lepcha) by Sikkim SLSA
- Posters have also been printed for display and for generating awareness which are distributed during programmes held by Sikkim SLSA, District Legal Services Authorities and Taluk Legal Services Committees
- An animated docu-film on mediation produced by Sikkim SLSA was launched on 14th October, 2016 by Hon’ble Mr Justice Madan B Lokur, the then Judge, Supreme Court of India & Member, Mediation & Conciliation Project Committee in the presence of Hon’ble Mr Justice Satish Kumar Agnihotri, the then Chief Justice, High Court of Sikkim/Patron-in-Chief, Sikkim SLSA and Hon’ble Mrs Justice Meenakshi Madan Rai, Judge, High Court of Sikkim & Executive Chairperson, Sikkim SLSA
