    Notification issued by Department of Home, Government of Sikkim with regard to the Scheme Sikkim Compensation to Victim or his Dependent Schemes, 2016

    Beneficiary:

    Victims or their Dependents, “Victim” means a person who has suffered loss or injury as a result of a crime and requires rehabilitation. This also includes dependent family members.

    Benefits:

    A Victim Compensation Fund is provided by the State Government to the State Legal Services Authority. Verified claims are paid from this fund. A provision for this fund is made annually in the State Budget.

    How To Apply

    Procedure for Applying for Compensation under the Scheme:

    1. Victims or their dependents may apply for compensation under sub-section (4) of Section 357-A of the Code of Criminal Procedure to the concerned District Legal Services Authority (DLSA). Alternatively, a court may recommend the case.

    2. The DLSA will verify the claim, including assessing the extent of loss or injury. Additional documents or information may be requested from the applicant.

    3. Based on the findings, the DLSA will forward its recommendation to the State Legal Services Authority (SLSA).

    4. The SLSA will determine the amount of compensation after considering:
    – The nature and extent of loss
    – Medical treatment costs
    – Minimum sustenance and rehabilitation needs
    – Any incidental expenses (e.g., funeral costs)

    5. Compensation shall not exceed the maximum limit specified in Schedule-I of the scheme.

    6. Once approved, the compensation will be disbursed from the Victim Compensation Fund to the applicant.
